In April 2014, Division Two of the Washington Court of Appeals affirmed the trial courts order denying the State's request to dismiss a WSP Troopers lawsuit on summary judgment. Commissioned Trooper Michelbrink alleged a deliberate intentional tort claim stemming from mandatory TASER; application during Washington State Patrol training where he claimed he suffered a bulging disk and vertebrae injury. Michelbrink submitted a workers compensation claim to Labor and Industries which was approved. He later sued his employer alleging intentional injury and outrage theories.
